§1. General Provisions

The website https://simtu.store/ operates under the principles set out in these Terms and Conditions.

The Terms and Conditions define the types and scope of services provided electronically through the website https://simtu.store/, the rules for providing these services, the conditions for concluding and terminating contracts for electronic services, as well as the complaint procedure.

Each Service Recipient, upon taking actions aimed at using the Electronic Services of the website https://simtu.store/, is obliged to comply with the provisions of these Terms and Conditions.
For matters not regulated by these Terms and Conditions, the following laws apply:

  1. The Act on the Provision of Electronic Services of July 18, 2002 (Journal of Laws No. 144, item 1204, as amended),
  2. The Consumer Rights Act of May 30, 2014 (Journal of Laws 2014, item 827),
  3. The Civil Code of April 23, 1964 (Journal of Laws No. 16, item 93, as amended) and other applicable provisions of Polish law.

§2. Definitions

CONTACT FORM – the form available on the website https://simtu.store/ that allows the Service Recipient to contact the Service Provider directly.

  • TERMS AND CONDITIONS – these Terms and Conditions of the Website.
  • SERVICE PROVIDER – SIMTU PROSTA SPÓŁKA AKCYJNA with its registered office at Ignacego Mościckiego 1, 24-110 Puławy, mailing address: Ignacego Mościckiego 1, 24-110 Puławy, NIP: 7162844039, REGON: 528746127, registered in the Central Register and Information on Business Activity, email address: info@simtu.store.
  • SERVICE RECIPIENT – a natural person, legal entity, or organizational unit without legal personality, granted legal capacity by law, using the Electronic Service.
  • ELECTRONIC SERVICE – a service provided electronically by the Service Provider to the Service Recipient via the Website.
  • NEWSLETTER – an Electronic Service allowing the Service Recipient to subscribe to and receive free information from the Service Provider via email.

§3. Type and scope of electronic services

The Service Provider enables the use of Electronic Services via the Website, such as:

  • using the Contact Form,
  • using the Newsletter.

 

The provision of Electronic Services to the Service Recipient takes place under the conditions specified in the Terms and Conditions.

§4. Conditions for providing and concluding contracts for electronic services

The provision of Electronic Services specified in Chapter III, point 1 of the Terms and Conditions by the Service Provider is free of charge.

The duration for which the contract is concluded:

  • The contract for the provision of the Electronic Service that enables sending a message via the Contact Form is concluded for a specified period and terminates upon sending the message or stopping the message submission by the Service Recipient.
  • The contract for the provision of the Electronic Service in the form of using the Newsletter is concluded for an indefinite period.
    The technical requirements necessary to cooperate with the IT system used by the Service Provider are:
  • a computer with internet access,
  • access to email,
  • a web browser,
  • cookies and JavaScript enabled in the web browser.

 

The Service Recipient is obliged to use the Website in a manner consistent with the law and good practices, respecting personal rights and intellectual property rights of third parties.
The Service Recipient is required to provide accurate data.
The Service Recipient is prohibited from providing illegal content.

§5. Conditions for providing and concluding contracts for electronic servicesterminating

Termination of the contract for the provision of Electronic Services:

  • The contract for the provision of a continuous and indefinite Electronic Service (e.g., use of the Newsletter) may be terminated.
  • The Service Recipient may terminate the contract with immediate effect and without giving reasons by sending a relevant statement via email to: info@simtu.store.
  • The Service Provider may terminate the contract for the provision of a continuous and indefinite Electronic Service if the Service Recipient violates the Terms and Conditions, particularly by providing illegal content, after an ineffective prior request to cease the violations with an appropriate deadline. The contract in such a case expires 7 days after the statement of intent to terminate it (notice period).
  • Termination leads to the cessation of the legal relationship for the future.

 

The Service Provider and the Service Recipient may terminate the contract for the provision of the Electronic Service at any time by mutual agreement.

§6. Complaint procedure

Complaints related to the provision of Electronic Services by the Service Provider:

Complaints related to the provision of Electronic Services via the Website can be submitted by the Service Recipient via email to: info@simtu.store.

The email should include as much information and context regarding the subject of the complaint as possible, particularly the type and date of the irregularity and contact details. The information provided will significantly facilitate and expedite the complaint handling process by the Service Provider.

The Service Provider will respond to the complaint promptly, no later than within 14 days.

The Service Provider’s response to the complaint will be sent to the email address of the Service Recipient provided in the complaint or in another manner specified by the Service Recipient.

§7. Intellectual property

All content posted on the website https://simtu.store/ is protected by copyright and is the property of https://simtu.store/. The Service Recipient is fully liable for any damage caused to the Service Provider as a result of using any content from the website https://simtu.store/ without the Service Provider’s consent.

Any use of any elements of the content and materials from the website https://simtu.store/ without the explicit written consent of the Service Provider constitutes a violation of the Service Provider’s copyright and will result in civil and criminal liability.

§8. Final provisions

Contracts concluded via the Website are concluded in accordance with Polish law.

In the event that any part of these Terms and Conditions is found to be inconsistent with applicable law, the relevant provisions of Polish law shall apply in place of the disputed provision.
